Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Aimatch LLC and govern your access to and use of the OurPic website, applications and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is operated by Aimatch LLC, a limited liability company organized under the laws of Wyoming, USA, with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801, USA ("Aimatch", "we", "us"). You can reach us at hello@ourpic.ai.

2. The Service

OurPic lets you generate short AI videos from photos you upload, using template presets available in our catalog. You choose a template, upload one or more photos, and our systems use third-party AI models to produce a video based on your photo and the selected template. Outputs are generated by artificial intelligence and will vary from one generation to the next.

3. Eligibility and accounts

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may only use the Service with the consent and under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. You are responsible for the accuracy of the information in your account and for keeping your login credentials secure, and you must notify us promptly of any unauthorized use of your account.

4. Credits, subscriptions and billing

Paid plans include a monthly allowance of credits that are consumed when you generate videos. Credits refresh on each billing cycle, and unused credits expire when your subscription ends. If a generation fails for technical reasons, the credits used for that generation are automatically returned to your balance.

Subscriptions are billed through our payment provider, Stripe, on a monthly or yearly basis and renew automatically at the end of each period. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period, and you keep access to your plan until then. Refunds are handled as described in our Refund Policy. We may change plan prices or credit allowances with reasonable advance notice; changes apply from your next renewal.

5. Your content and license

You keep ownership of the photos you upload and of the videos you generate. By uploading content you grant Aimatch a limited, worldwide, non-exclusive license to host, store, reproduce and process that content solely as needed to operate, provide and improve the Service — for example, transmitting your photo to an AI model provider in order to generate your video. This license ends when you delete your content or your account, except where retention is required by law.

You represent and warrant that you own, or have obtained, all rights necessary to the photos you upload, and that every person depicted in them has consented to the use of their image on the Service.

Videos generated on the free plan are for personal, non-commercial use. Commercial use of generated videos is permitted on the Pro and Ultra plans.

6. Prohibited uses

You may not use the Service to:

  • impersonate any person or entity, or create deepfakes of real people without their explicit consent;
  • create sexual or sexually suggestive content involving real persons;
  • depict minors in any inappropriate, sexualized or exploitative context;
  • commit fraud, harassment, defamation or intimidation;
  • present AI-generated content as authentic footage with the intent to deceive (misinformation);
  • upload content that infringes the intellectual property, privacy or publicity rights of others;
  • violate any applicable law or regulation.

We may remove content, refuse generations, and suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation.

7. AI disclaimer

AI outputs are probabilistic. Generated videos may contain inaccuracies, distortions or visual artifacts, and may not match your expectations. The Service and all outputs are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of merchantability or fitness for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, Aimatch's total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or for loss of profits or data. Nothing in these Terms limits liability that cannot be limited under applicable law, nor mandatory consumer rights in your country of residence.

9. Changes to these Terms

We may update these Terms from time to time. For material changes we will give you notice — for example by email or an in-product message — before the changes take effect. Continuing to use the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules — and without prejudice to mandatory consumer protection rules of your country of habitual residence (for example, the Brazilian Consumer Protection Code) that apply to you regardless of this choice of law.
